Privacy Notice

This notice explains how personal data is handled when you use FencetaAI. Effective October 1, 2026.

1. Controller

Kendreas Zy'Shaun Divens, the seller of FencetaAI, is the data controller for personal data described in this notice. Organizations using FencetaAI may separately act as controllers for customer, worker, and prospect information they enter, while we process that information to provide the service. Privacy questions and rights requests can be submitted through our contact page.

2. Personal data we collect

We collect account and identity data such as names, email addresses, login records, roles, and organization details; service data such as customers, properties, site notes, photos, estimates, proposals, schedules, invoices, costs, and communications; support data such as messages and issue details; and technical and usage data such as IP address, device and browser information, timestamps, feature activity, diagnostics, security events, and cookie identifiers. Paddle independently collects payment and billing details during checkout.

3. Purposes and legal bases

We use account, organization, and service data to create accounts, provide requested features, maintain records, and support users, based on performance of our contract. We use technical, usage, and support data to secure the service, prevent fraud, diagnose problems, respond to requests, and improve reliability, based on our legitimate interests. We process data when necessary to comply with tax, accounting, consumer-protection, and other legal obligations. Where consent is required, including for optional non-essential cookies or marketing, consent is the legal basis and may be withdrawn at any time.

4. Who receives data

We share personal data only as needed with hosting, database, storage, email, analytics, security, AI-processing, and customer-support providers acting under contract; professional advisers such as legal and accounting providers; a buyer or successor in a business transaction; and authorities where required by law or necessary to protect rights and safety. We share relevant account, order, and subscription data with Paddle, our Merchant of Record, for checkout, sale of the product, subscription management, payment processing, tax compliance, fraud prevention, customer service, refunds, and invoicing. Paddle processes data under its own privacy notice.

5. Organization access and security

Authorized members of your organization can access information according to assigned roles. We use appropriate technical and organizational safeguards, including access controls, authentication, encrypted transmission, private file storage, audit and security monitoring, and restricted administrative access. No system can guarantee absolute security, so users must also protect their credentials and devices.

6. Retention

We retain account and service data while an account is active and afterward only as long as reasonably needed to provide exports, resolve disputes, enforce agreements, prevent fraud, maintain security, and meet legal, tax, and accounting obligations. Support and diagnostic records are retained according to operational need. When data is no longer required, we delete or anonymize it; residual copies may remain temporarily in protected backups until those backups cycle out.

7. International transfers

Our providers may process data in countries other than your own. Where laws require transfer safeguards, we rely on recognized mechanisms such as adequacy decisions, standard contractual clauses, and supplementary security measures.

8. Your privacy rights

Depending on your location, you may have rights to access, correct, delete, restrict, or receive a portable copy of personal data; object to certain processing; withdraw consent; and appeal or complain to your local data-protection authority. UK and EEA requests are generally answered within one month, subject to lawful extensions. We may verify identity before acting on a request. Some data may be retained where law permits or requires it.

9. Cookies

FencetaAI uses essential cookies and similar storage for sign-in, session continuity, security, preferences, and payment functionality. Optional analytics or marketing cookies are used only where enabled and, when required, after consent. You can manage optional choices through available consent controls and browser settings; blocking essential cookies may stop parts of the service from working.

10. Updates and contact

We may update this notice as the service or legal requirements change. Material changes will be posted here with a revised effective date. Submit privacy questions or rights requests through our contact page.
